An agent is a relationship existing between a principal and an agent. In the case of real estate, a real estate agency in Jamaica has a function to create a contractual relationship between a principal and a third party.

Agency creation
The power of a Jamaican real estate agency to act may occur in one of five ways.

1. Express Authority

2, apparent authority

3. Ratification

4. Necessity

1. Express Authority
Explicit authority to act on behalf of a principal (also called an agency) as an agent in the place of an agent can be done in writing. 2. Apparent authority

Ratification is retrospective in its operation, that is, the parties are placed in a position where the agent would have the authority he was said to have had if the contract was concluded. This is probably the most basic of knowledge of the real estate market in Jamaica. Most investors are aware of ratification in Jamaica's property investment guidelines.

4. Agency of Needs
This arises from the operation of the law, occurs when another person is entrusted with another property, and there is a need to do something to protect that property due to an emergency situation. Those who are entrusted with real estate do not have express authority to do the necessary acts to preserve it for the sake of necessity, but authority is guessed.

Three conditions must be fulfilled before the necessity agency occurs.

5. Co-home agent
In customary law, where the husband and wife live together, the wife is presumed to have the authority of a husband who promises his credit for necessities judged according to her husband style and living standard. Estimates by agents are not from marriage, but from living together. He also applies to women living with men as mistresses as well. If the husband proves, the estimate can be refuted:
