Tort is a misbehavior, damage, or injury that was done in a situation with intention, negligence or severe responsibility. However, tort law does not include contract vacation that may lead to the civil law. Recently, we saw that supporters of the legal system of this country are trying to link lawsuits of various cases, such as retiring medical professionals and closing public parks.
Most of these supporters agree that the current tort laws of this country are giving great distortion to the economy. This problem is becoming extremely serious, even President Bush is promoting the revision of the Tort Law that improves economic growth, especially through the creation of new jobs. Tort lawsuits do not go anywhere and in some cases are beneficial, but the current law pushes liability insurance to an excessive level in many areas.
For example, due to the high cost of illegal litigation, wages have declined, corporate profits are greatly affected, productivity declines, and research and development is also disappointing. In short, the cost increase due to tort is to have a dynamic impact on society. Often there are opportunities to boost the economy by changing the current illegal behavior system and many feel that the new illegal act system actually has the opposite effect in hindering the development of new employment.
Let's see how the current tort action system works. Mothers and children will spend a fine afternoon at the local communal pool. My mother goes inside to drink something while the child is jumping from the pool side in the water. At the same time, the employee's lifeguard is working in a different place in the pool. The child jumps to the shallow edge, strikes the head to the bottom of the pool, and paralyzes. Mothers can not sue in the court, but claims of negligence against life guards will bear the defense attorneys fee.
Now, applying current laws of torts on all aspects of society, we can know the importance of the problem. For example, a woman who bought from McDonald's and spilled hot coffee on rap was actually awarded money. The allegation in her case was not not a warning that the coffee was too hot, it was not that she did not spill it. There are many examples where current laws of torts affect the economy of this society.
Keep in mind that tort laws bring profits. For example, unsafe products, appropriate practices, respectful solutions are all good. However, looking at the laws of current torts and comparing strengths and weaknesses, several serious problems emerge. Changing this law is being scrutinized to determine whether the new tort law actually pushes the economy, while providing necessary protection in case of misconduct, damage or injury.
